KMA to remove Unauthorised Temporary Structures
The Kumasi Metropolitan Assembly (KMA) has announced strict enforcement of planning laws governing temporary structures across the Kumasi Metropolis, warning that unauthorised kiosks, containers and sheds risk removal, prosecution, and cost recovery.
In a public notice on Monday, issued by its Public Relations Unit, the Assembly said all temporary structures within the metropolis must now go through the statutory planning approval process under the Land Use and Spatial Planning Act, 2016 (Act 925) and the Land Use and Spatial Planning Regulations, 2019 (L.I. 2384).
“For the avoidance of doubt, no person shall erect, install, place, or occupy any temporary structure without first obtaining the requisite planning approval from the appropriate statutory authority,” the statement read.
According to KMA, temporary structures subject to approval include shipping containers used for commercial purposes, kiosks and metal containers, temporary sheds, pavilions, site offices, temporary market stalls, event tents intended for extended use, and any other temporary development requiring planning permission.
The Assembly said applications for such structures will be considered and approved by its Spatial Planning Committee through the established statutory permitting process.
KMA warned that persons or institutions who erect or occupy temporary structures without approval will be deemed to be in contravention of planning laws.
Enforcement actions, the Assembly noted, may include: issuance of enforcement notices, removal or demolition of the unauthorised structure, cost recovery for enforcement actions and prosecution as provided by law.
“The KMA therefore urges all developers and members of the public to regularise existing unauthorised temporary structures where applicable and obtain the necessary approvals before commencing any new temporary development,” the notice added.
The directive is expected to affect traders, developers, and businesses operating in containers and kiosks across markets, streets, and commercial areas in Kumasi.
